On 29 April 2025 the registrant informed the General Dental Council (GDC) that she had received a caution on 20 January 2025 for assault. The case examiners have considered allegations relating to that caution, and a failure to immediately inform the GDC of the caution.
The case examiners concluded that there was a real prospect of a practice committee finding most of the factual allegations proved and a real prospect of those allegations being found to amount to the statutory grounds of misconduct and caution, but no real prospect of the registrant’s fitness to practise being found to be currently impaired.
The case examiners reminded themselves that the registrant has been dealt with by the criminal justice system, and that it is not their role, or the purpose of the fitness to practise process, to punish her for a second time. They considered, however, that the registrant’s overall conduct, involving as it did not notifying the GDC of this in a timely manner, may represent a significant departure from the standards expected of a dental professional, as set out in Standards for the Dental Team (2013):
• 9.1 – You must ensure that your conduct, both at work and in your personal life, justifies patients’ trust in you and the public’s trust in the dental profession, and
• 9.3 – You must inform the GDC if you are subject to criminal proceedings or a regulatory finding is made against you, anywhere in the world.
The case examiners are therefore satisfied that it is appropriate and proportionate to issue the registrant with a warning, in order to indicate to the registrant that such conduct represents a significant departure from these standards and must not be repeated.
Furthermore, the case examiners consider that publication of the warning for a period of 6 months will satisfy the public interest in this matter and will ensure that the registrant and members of the wider dental professions are aware of the importance of maintaining appropriate standards of behaviour and conduct.
The registrant is reminded that this warning will form part her fitness to practise history, even after it is no longer published, and may need to be disclosed as required.
The case examiners warn the registrant that:
• the commission of a criminal offence can have an adverse effect on the wider public interest, and this conduct should not be repeated. Any further criminal convictions will be viewed seriously and will likely call into question her fitness to practise.
• she should, as required by GDC guidance, maintain appropriate standards of behaviour in her professional and personal life.
