The case examiners considered an allegation that the registrant’s fitness to practise is impaired by reason of misconduct. The supporting factual allegations related to the registrant failing to hold adequate indemnity insurance from 28 July 2022 to 8 December 2023 and that in doing so was misleading and dishonest. It was determined by the case examiners that there was a real prospect of some of the factual allegations being found proved, which did not include the dishonesty allegation, and that the statutory ground of misconduct had a real prospect of being established by a practice committee. The case examiners have also taken into account the GDC’s ‘Case Examiner Indicative Outcomes Guidance’ (2018) publication, and provisions within the GDC’s ‘Case Examiner Guidance Manual’ (2016) and given due regard to this case’s aggravating and mitigating factors. They consequently consider that a warning in this case is necessary to declare and uphold proper standards of conduct, as well as to promote the importance of ensuring appropriate indemnity insurance is in place to safeguard patients’ right to compensation. Furthermore, the case examiners consider that publication of this warning for a period of 6 months is appropriate and proportionate in the circumstances and will ensure that this emphasises to the registrant, and to the dental profession, the importance of maintaining the standard of conduct required for GDC registrants. The registrant is reminded that this warning will form part of her fitness to practise history, even after it is no longer published and may need to be disclosed as required. The case examiners formally warn the registrant that failure to ensure professional indemnity, or insurance, is current and fully covers their scope of practice may prevent patients from receiving necessary compensation if harmed. The registrant must consequently ensure appropriate professional indemnity, or insurance, is always in place when practising dentistry.
