Undertaking:
The Case Examiners considered allegations that the Registrant’s fitness to practise is impaired by reason of misconduct. The allegations related to the Registrant not providing an adequate standard of care to four patients between 2019 and 2022, including by failing to carry out sufficient diagnostic and pre-treatment assessments ; her radiographic practice; failing to carry out sufficient treatment planning and providing a written treatment plan; her antibiotic prescribing practice; failing to obtain informed consent; not maintaining an adequate standard of record keeping; and failing to ensure patient records were stored securely. The Case Examiners determined to offer undertakings to the Registrant. They found there to be a real prospect of most of the facts alleged being found proved by a Practice Committee, a real prospect of the statutory ground of misconduct being established and a real prospect of a finding of current impairment. The Case Examiners consider that the Registrant has reflected upon her performance, recognises her shortcomings and has shown some insight. In light of this, the Case Examiners consider that undertakings are a suitable disposal for this case, and would ensure that the Registrant’s remediation is fully embedded. The Case Examiners further consider that undertakings would satisfy the public interest by protecting the public; declaring and maintaining proper professional standards; and maintaining public confidence in the profession and its effective regulation. The Case Examiners consider that, in light of the action already taken by the Registrant, a period of 18 months would be sufficient for the undertakings to be effective.
1. She must notify the GDC within 7 days of all of her professional appointments and provide the contact details of any organisation for which she has a contract or arrangement to provide dental services and details of all the NHS regional teams/Health Boards with whom she has an arrangement, either as a contract holder or by being on their Dental Performers’ List. 2. She must allow the GDC to exchange information with her employer or any organisation for which she has a contract or arrangement to provide dental service, and any Postgraduate Dental Dean/nominated deputy, or workplace supervisor referred to in these undertakings. 3. She must inform the GDC within 7 days of any formal disciplinary proceedings taken against her from the date these undertakings take effect. 4. She must inform the GDC within 7 days of any complaints made against her from the date these undertakings take effect. 5. She must inform the GDC if she applies for dental employment outside the UK within 7 days of the date of application. 6. She must inform the GDC if she is registered or subsequently applies for registration with any other overseas regulator/relevant authority within 7 days of the date of application [for future registration] or 7 days from the date these undertakings take effect [existing registration]. 7. She must work with a Postgraduate Dental Dean/nominated deputy to formulate a Personal Development Plan, specifically designed to address alleged deficiencies in the following areas of her practice: • Clinical assessment of patients, inclusive of diagnostic assessments, pre-treatment investigations and treatment planning • Radiographic practice • Valid consent • Record keeping • Safe storage of clinical records • Antibiotic prescribing 8. She must provide a copy of the full Case Examiner decision relating to these undertakings to the Postgraduate Dental Dean/nominated deputy and provide evidence of this to the GDC within 21 days of the date these undertakings take effect. 9. She must provide a copy of her Personal Development Plan to the GDC within 3 months from the date these undertakings take effect. She must provide an updated copy of her Personal Development Plan to the GDC 5 months prior to the expiry of these undertakings. 10. She must meet with the Postgraduate Dental Dean/nominated deputy on a regular basis to discuss her progress towards achieving the aims set out in her Personal Development Plan. The frequency of these meetings is to be set by the Postgraduate Dental Dean/ nominated deputy.
11. She must advise the GDC of the contact details of the Postgraduate Dental Dean/nominated deputy and allow the GDC to exchange information about the standard of her professional performance and her progress towards achieving the aims set out in her Personal Development Plan with the Postgraduate Dental Dean/nominated deputy, and any other person involved in her retraining and supervision. 12. a) At any time she is providing services, which require her to be registered with the GDC, she must place herself and remain under the supervision* of a workplace supervisor nominated by herself and agreed by the GDC. The workplace supervisor shall be a GDC registrant in the same category of the register as the Registrant or higher. 13. She must provide reports from her workplace supervisor to the GDC every 3 months and the GDC will make these reports available to any Postgraduate Dental Dean/nominated deputy. These reports must include comments in relation to the required audits as detailed below (Undertaking 15). 14. She must keep her professional commitments under review and limit her dental practice in accordance with her workplace supervisor’s advice. 15. a) She must undertake an audit every 3 months in the areas of patients’ clinical assessments, radiographic practice, antibiotic prescribing, record keeping and valid consent. These audits must be signed by her workplace supervisor. b) She must provide copies of these audits to the GDC every 3 months. 16. a) She must inform, within 7 days, the following parties that her registration is subject to the undertakings listed at (1) to (15), above: • Any organisation or person employing or contracting with her to undertake dental work • Any locum agency or out-of-hours service she is registered with or applies to be registered with (at the time of application) • Any prospective employer (at the time of application) • The Commissioning Body on whose Dental Performers List she is included or seeking inclusion, or Local Health Board if in Wales, Scotland or Northern Ireland (at the time of application) b) She must forward written evidence of her compliance with this undertaking to the GDC within 7 days. 17. She must permit the GDC to disclose the above undertakings, (1) to (16), to any person requesting information about her registration status. * Supervised: the workplace supervisor must supervise the registrant’s day-to-day work in a way prescribed in the relevant condition or undertaking. The workplace supervisor does not need to work at the same practice as the registrant, but they must be available to provide advice or assistance if the registrant needs it. Where the workplace supervisor is unavailable through illness or planned absence, the registrant must not work, unless an approved alternative workplace supervisor is in place. The workplace supervisor must review the registrant’s work at least once a fortnight in one-to-one meetings and case-based discussions. These meetings must focus on all areas of concern identified by the conditions or undertakings. These meetings should usually be in person. If this is not possible, at least one of every two fortnightly meetings must be in person
