Undertaking:
The Case Examiners considered allegations relating to the Registrant having failed to provide an adequate standard of dental care for 12 patients, between August 2024 and September 2024, which involved matters such as diagnostic assessments, radiographic practice, and patient communications. In addition, allegations concerning the standard of the Registrant’s clinical record keeping, compliance with infection control requirements, the type of assistance sought from supporting dental nurses and the accuracy of certain information contained in a provided CV, were also considered. The Case Examiners were satisfied that there was a real prospect of a Practice Committee finding most of the allegations proved and of there being a real prospect of these amounting to the statutory grounds of misconduct and deficient professional performance. They were also satisfied that there was a real prospect of the Registrant’s fitness to practise being found to be currently impaired by a Practice Committee. To address this issue of alleged current impairment the Case Examiners considered that undertakings would be an effective, proportionate and adequate measure in protecting the public and maintaining public confidence in the dental professions. The agreed undertakings will remain in force for a period of 18 months and have a review prior to their expiry. 1. She must notify the GDC within 7 days of all her professional appointments accepted and provide the contact details of any organisation for which she has a contract or arrangement to provide dental services, and details of all the NHS regional teams/Health Boards with whom she has an arrangement, either as a contract holder or by being on their Dental Performers’ List. 2. She must allow the GDC to exchange information with any organisation for which she has a contract or arrangement to provide dental services, and any workplace supervisor referred to in these undertakings. 3. She must inform the GDC within 7 days of any complaints made against her from the date these undertakings take effect. 4. She must inform the GDC within 7 days of any formal disciplinary proceedings taken against her, by an employer, from the date these undertakings take effect. 5. She must inform the GDC if she applies for dental employment outside the UK within 7 days of the date of application. 6. She must inform the GDC if she is registered or subsequently applies for registration with any other overseas regulator/relevant authority within 7 days of the date of application for future registration or 7 days from the date these undertakings take effect for existing registration. 7. She must provide a copy of the full Case Examiner decision relating to these undertakings to the workplace supervisor and provide evidence of this to the GDC within 21 days of the date these undertakings take effect. 8a. At any time, she is providing services which require her to be registered with the GDC, she must place herself and remain under the close* supervision of a workplace supervisor nominated by herself and agreed by the GDC. The workplace supervisor shall be a GDC registrant in the same category of the register as the Registrant or higher. 8b. She must not start/restart work until a workplace supervisor has been approved by the GDC. 9. She must maintain logs** of the following: • Examination, to include assessment, diagnosis and obtaining of medical histories. • Record keeping. • Radiographic practice. • Local anaesthetic practice. • Dental restoration technique. • Hygiene and cross infection control. • Consultation with patients, to include discussions about their dental needs and treatment plans.
10. The logs, as referred to in ‘9’ above, must be signed by her workplace supervisor. 11. She must provide a copy of these logs, as referred to in ‘9’ above, to the GDC at intervals of two months or alternatively confirm that there have been no such cases. 12. She must provide her workplace supervisor’s reports to the GDC at intervals of two months, and these reports are to comment on the following: • Examination. • Record keeping. • Radiographic practice. • Local anaesthetic practice. • Dental restoration technique. • Hygiene and cross infection control. • Assessment and diagnosis. • Consultation with patients, to include discussions about their dental needs and treatment plans. • Full detail of the discussions between the Registrant and her workplace supervisor. • A review of the logs and any action points resulting from the meetings between the Registrant and her workplace supervisor. 13. She must keep her professional commitments under review and limit her dental practice in accordance with her workplace supervisor’s advice. 14. She must stop working immediately if her workplace supervisor directs her to do so, and she must inform the GDC within 7 days of receiving this direction. 15. She must not work as a locum or undertake any out-of-hours work or on-call duties. 16. She must inform, within 7 days, the following parties that her registration is subject to the undertakings listed at (1) to (15), above: a. Any organisation or person employing or contracting with her to undertake dental work. b. Any prospective employer (at the time of application). c. The Commissioning Body on whose Dental Performers List she is included or seeking inclusion, or Local Health Board if in Wales, Scotland or Northern Ireland (at the time of application). She must forward written evidence of her compliance with this undertaking to the GDC within 7 days. 17. She must permit the GDC to disclose the above undertakings, (1) to (16), to any person requesting information about her registration status. Please refer to the GDC’s ‘Fitness to Practise Glossary of Terms’ publication for definitions relating to *close supervision and **logs, which are stated to be: • “2. Closely supervised: the workplace supervisor must supervise the registrant’s day-to-day work in a way prescribed in the relevant condition or undertaking. The workplace supervisor must always be on site and available when the registrant is working. Where the workplace supervisor is unavailable through illness or planned absence, the registrant must not work unless an approved alternative workplace supervisor is in place. The workplace supervisor must review the registrant’s work at least twice a week in one-to-one meetings using case-based discussions. These meetings must focus on all areas of concern identified by the conditions or undertakings. These meetings can be in person or via video conferencing.” • “Logs A log is a record made during, or directly after, the treatment or activity, as specified in a set of conditions or undertakings. Conditions or undertakings will specify if someone should verify the log. The log must always include: • Registrant’s name. • Date of the activity/treatment. • Patient’s anonymous identifier or patient number. • Any other information needed to meet the requirements of the relevant condition or undertaking. For clinical cases, in addition the log must always include: • Patient's clinical issues or presenting problem. • The activity/treatment undertaken. • Outcome. • Any relevant medical history.”
