Undertaking:
The General Dental Council received a self-referral from the Registrant which supported the view that her practice of dentistry should be restricted in certain respects. The Case Examiners found a real prospect of the factual allegation being found proved, a real prospect that this would amount to an allegation of impaired fitness to practise by reason of the statutory ground alleged and a real prospect of a Practice Committee finding the Registrant’s fitness to practise to be currently impaired. The Case Examiners concluded that the information before them indicated that it was appropriate for the Registrant to continue to be registered as a Dentist. The Case Examiners have determined that the Registrant should be invited to agree a set of Undertakings, which will enable the General Dental Council to monitor and restrict her professional activities and ensure that patients and the public are protected. The Case Examiners considered that the Undertakings would serve to retain some of the services of a trained Dentist for the benefit of patients, whilst protecting patients and maintaining the confidence of the public in the dental profession. If agreed, the Undertakings will remain in place for a period of 18 months with a review prior to their expiry and are listed below
1. She must notify the GDC within 7 days of any professional appointment she accepts or is currently undertaking and provide the full name and contact details of her employer, any organisation for which she has a contract or arrangement to provide dental services and all the NHS regional teams/Health Boards with whom she has an arrangement, either as a contract holder or by being on their Dental Performers’ List. 2. She must allow the GDC to exchange information with her employer, any organisation for which she has a contract or arrangement to provide dental services, all the NHS regional teams/Health Boards with whom she has an arrangement. 3. She must inform the GDC within 7 days of any formal disciplinary proceedings taken against her from the date these undertakings take effect. 4. She must inform the GDC within 7 days of any complaints made against her from the date these undertakings take effect. 5. She must inform the GDC within 7 days if she applies for dental employment outside the UK from the day these undertakings take effect. 6. She must inform the GDC if she is registered or applies for registration with any overseas regulator/relevant authority, within 7 days of the date of the application or 7 days from the date of this determination if already registered. 7. [PRIVATE] 22. She must not work as a locum or undertake any out-of-hours work or on-call duties outside of her current position. 23. At any time she is employed, or providing dental services which require her to be registered with the GDC, she must agree to the appointment of a reporter nominated by her and approved by the GDC. The reporter shall be a GDC registrant with the same or higher registration category than her who must work in the same practice as her. She must not start/restart work until these arrangements have been approved by the GDC. 24. She must allow the reporter to provide reports to the GDC regarding any concerns or complaints against her every three months. 25. She must inform within 7 days the following parties that her registration is subject to the undertakings, listed above at 1 to 24, and provide evidence to the GDC that this has been done within 7 days: • Any organisation or person employing or contracting with her to undertake dental work; • Any prospective employer (at the time of application); • The Commissioning Body or on whose Dental Performers List she is included or seeking inclusion (at the time of application); • Her reporter; • [PRIVATE] • [PRIVATE] • [PRIVATE] 26. She must permit the GDC to disclose the above undertakings 1 to 6 and 22 to 25 to any person requesting information about her registration status.
