Undertaking:
The circumstances of this matter relate to the standard of care provided by the Registrant to nine patients between 2017 and 2020. The Informant in this case is NM, a Dental Department Manager. Following an investigation by the GDC, the Registrar has raised an allegation of impairment by reason of misconduct and/or deficient professional performance based upon concerns relating to; diagnostic assessments, pre-treatment investigations, treatment planning, standard of treatment, management of pain, radiography, record keeping and informed consent. The Case Examiners have determined that there is a real prospect of most of the factual allegations being found proved, a real prospect of a Practice Committee finding these facts would amount to misconduct and deficient professional performance, and a real prospect of a Practice Committee finding the Registrant to be currently impaired. The Case Examiners consider that the alleged conduct is remediable, and Registrant has demonstrated insight into those areas of practice identified in this case and has also shown a willingness to undertake remedial action. In light of this, the Case Examiners consider that undertakings are a suitable disposal for this case and would ensure that the Registrant’s remediation is fully embedded. The Case Examiners further consider that undertakings would satisfy the public interest, namely, public protection, the declaration of proper professional standards and the need to maintain public trust in the profession and its effective regulation. The Case Examiners consider that a period of 18 months would be sufficient for the undertakings to be effective. 1. She must notify the GDC within 7 days of any professional appointment she accepts or is currently undertaking and provide the contact details of her employer or any organisation for which she has a contract or arrangement to provide dental services and details of all the NHS regional teams/Health Boards with whom she has an arrangement, either as a contract holder or by being on their Dental Performers’ List. 2. She must allow the GDC to exchange information with her employer or any organisation for which she has a contract or arrangement to provide dental services, and any Development Adviser/nominated deputy, reporter or workplace supervisor referred to in these undertakings. The Development Adviser should be nominated by the Registrant and approved by the GDC. 3. a. At any time, she is providing dental services which require her to be registered with the GDC, she must agree to the appointment of a reporter nominated by her and approved by the GDC. The reporter shall be a GDC registrant in the same category of the register as the registrant or higher. This could be the same person as the workplace supervisor. b. She must not start/restart work until these arrangements have been approved by the GDC. 4. She must provide reports from her reporter to the GDC every 3 months and the GDC will make these reports available to any Development Adviser/nominated deputy or workplace supervisor referred to in these undertakings on request. The reports will include the following areas: a. confirmation that the Registrant is complying with their undertakings b. confirmation of any complaints received and the outcome c. confirmation of any concerns raised in the workplace about the Registrant 5. She must inform the GDC within 7 days of any formal disciplinary proceedings taken against her from the date these undertakings take effect. 6. She must inform the GDC within 7 days of any complaints made against her from the date these undertakings take effect. 7. She must inform the GDC if she applies for dental employment outside the UK within 7 days of the date of application.

She must inform the GDC if she is registered or subsequently applies for registration with any other overseas regulator/relevant authority within 7 days of the date of application for future registration or 7 days from the date these undertakings take effect for existing registration. 9. She must work with a Development Adviser/nominated deputy, to formulate a Personal Professional Development Plan, specifically designed to address the deficiencies in the following areas of her practice: i. diagnosis ii. treatment planning iii. consent iv. restorative work v. record keeping vi. radiographic practice vii. referrals 10. She must provide a copy of the full Case Examiner decision relating to these undertakings to the Development Adviser/nominated deputy, workplace supervisor and reporter and provide evidence of this to the GDC within 21 days of the date these undertakings take effect. 11. She must provide a copy of her Personal Professional Development Plan to the GDC every 3 months, from the date these undertakings take effect. 12. She must meet with the Development Adviser/nominated deputy, on a regular basis to discuss her progress towards achieving the aims set out in her Personal Professional Development Plan. The frequency of these meetings is to be set by the Development Adviser/nominated deputy. 13. She must allow the GDC to exchange information about the standard of her professional performance and her progress towards achieving the aims set out in her Personal Professional Development Plan with the Development Adviser/nominated deputy, and any other person involved in her retraining and supervision. 14. a. At any time, she is providing services which require her to be registered with the GDC, she must place herself and remain under the supervision* of a workplace supervisor nominated by herself and agreed by the GDC. The workplace supervisor shall be a GDC registrant in the same category of the register as the Registrant or higher. This could be the same person as the reporter. b. She must not start/restart work until these arrangements have been approved by the GDC. 15. She must provide reports from her workplace supervisor to the GDC every 3 months and the GDC will make these reports available to any Development Adviser/nominated deputy or reporter referred to in these undertakings on request. The reports will include the following areas: a. confirmation of progress in relation to remedial activities including i. diagnosis ii. treatment planning iii. consent iv. restorative work v. record keeping vi, radiographic practice b. the audits referred at Undertaking 16 below, should be signed by the workplace supervisor to verify the information. 16. She must carry out audits and provide those audits to the GDC every 3 months. The audits must cover the same areas as the workplace supervisor’s report in relation to remedial activities (as listed at undertaking 15(a) above) and signed by the workplace supervisor. 17. Direct Observation of procedures - She must allow her workplace supervisor to observe her whilst she is treating patients, at least once every four months. A minimum of 15 procedures must be directly observed by the workplace supervisor during the undertakings period and should focus on all areas of concern identified by the undertakings. The workplace supervisor should assess her performance against the standard of professional practice reasonably expected of a registrant working in the same discipline, and then give feedback and discuss the learning needs highlighted by the assessment. A record of the observations should be included in the workplace supervisor reports provided to the GDC, and where applicable include comments in respect of the following areas; • Patient examination • Diagnosis/clinical judgement • Treatment planning • Procedural knowledge • Technical ability • Communication (patient and staff) • Registrant’s insight into own performance
18. Case Based Discussions - She must provide a verbal presentation of her management of a clinical case to the workplace supervisor. A minimum of 15 case-based discussions must be completed within the undertakings period. The workplace supervisor should assess the Registrant’s performance in the case-based discussions against the standard of professional practice reasonably expected of a registrant working in the same discipline, and then give feedback and discuss the learning needs highlighted by the assessment. A record of the observations should be included in the workplace supervisor reports provided to the GDC, and where applicable include comments in respect of the following areas; • Patient record keeping • Investigations/referrals • Clinical diagnosis • Treatment planning • Follow up/patient management • Overall clinical judgement • Registrant’s insight into their own performance 19. Reflective writing a. She must read the Good Practice Guidelines, Clinical Examination and Record Keeping, Faculty of General Dental Practice (UK) and the Royal College of Surgeons of England, 2005/2009/2016 and provide a written reflection to the GDC within 3 months from the date these undertakings take effect. The reflection should demonstrate that she has identified her learning needs, and recognised the steps needed to improve her practice. b. She must read the Selection Criteria for Dental Radiography, Faculty of General Dental Practice (UK), 3rd Edition, Horner K, Eaton K, FGDP (UK), 2013 and provide a written reflection to the GDC within 3 months from the date these undertakings take effect. The reflection should demonstrate that she has identified her learning needs, and recognised the steps needed to improve her practice. c. She must read the GDC’s Standards for the Dental Team (September 2013) and provide a written reflection to the GDC within 3 months from the date these undertakings take effect. The reflection should demonstrate that she has identified her learning needs, and recognised the steps needed to improve her practice. 20. She must keep her professional commitments under review and limit her dental practice in accordance with her workplace supervisor’s advice. 21. She must inform, within 7 days the following parties that she registration is subject to the undertakings listed at (1) to (17), above: a. Any organisation or person employing or contracting with her to undertake dental work b. Any locum agency or out-of-hours service she is registered with or applies to be registered with (at the time of application) c. Any prospective employer (at the time of application) d. The Commissioning Body on whose Dental Performers List he is included or seeking inclusion, or Local Health Board if in Wales, Scotland or Northern Ireland (at the time of application) She must forward written evidence of her compliance with this undertaking to the GDC within 7 days. 22. She must permit the GDC to disclose the above undertakings, (1) to (17), to any person requesting information about her registration status *Supervision Another GDC registrant must supervise the Registrant’s day-to-day work in a way prescribed in the relevant condition or undertaking. The workplace supervisor need not work at the same practice as the Registrant, and there is no geographical restriction for the appointment of the supervisor (a GDC registered supervisor based on the UK mainland is permitted). The supervisor must make themselves available to provide advice or assistance should they be required. The supervisor must review the Registrant’s work at least once a fortnight in one-to-one meetings. These meetings must focus on all areas of concern identified by the undertakings. These meetings should usually be in person. If this is not possible, at least one of every two fortnightly meetings must be in person.
