The Case Examiners considered an allegation that the Registrant’s fitness to practise is impaired by reason of misconduct. The supporting factual allegations related to the Registrant failing to disclose a police conditional caution from December 2018 on her GDC Dental Care Professional’s application form in June 2020 and not having indemnity insurance in place from 31 May 2022 to 15 July 2022. It was determined by the Case Examiners that there was a real prospect of most of the factual allegations being found proved and that the statutory ground of misconduct also had a real prospect of being established by a Practice Committee. They further determined that due to it seeming to be highly unlikely the alleged conduct would be repeated, and that the case’s circumstances may not have sufficiently engaged the wider public interest, there was no real prospect of the Registrant’s fitness to practise being found to be currently impaired by a Practice Committee. However, to close the case without action would fail to take into account the wider public interest, which includes the need to declare and uphold proper standards of conduct, and the need to maintain public confidence in the dental profession. The Case Examiners therefore consider that a warning in this case is necessary to declare and uphold proper standards of behaviour and conduct, as well as to mark the serious impact which unprofessional behaviour can have on the reputation of the profession. Further, the Case Examiners consider that publication of the warning for a period of 6 months is appropriate and proportionate in the circumstances, and will ensure that a message is sent to the Registrant and to the wider profession The Registrant is reminded that this warning will form part of her fitness to practise history, even after it is no longer published and may need to be disclosed as required. The Case Examiners formally warn the Registrant that she must ensure: • when necessary, that appropriate insurance or indemnity is in place so that patients can seek compensation if they have suffered harm - this is to ensure compliance with the General Dental Council’s “Standards for the Dental Team” (September 2013) publication’s Standard 1.8 (You must have appropriate arrangements in place for patients to seek compensation if they have suffered harm) • that due diligence must be undertaken when providing information to the GDC, such as in the completion of a formal document submitted to the GDC, to ensure that only accurate information is supplied - this is to ensure compliance with the General Dental Council’s “Standards for the Dental Team” (September 2013) publication’s Standard 9.1 (You must ensure that your conduct, both at work and in your personal life, justifies patients’ trust in you and the public’s trust in the dental profession).
