Conditions:
1. The following conditions can only be fulfilled in the UK.
2. He must notify the GDC within 7 days of any post he accepts for which GDC registration is required and the Commissioning Body on whose Dental Performers List he is included.
3. If employed, he must provide contact details of his employer within 7 days and allow the GDC to exchange information with his employer or any contracting body for which he provides dental services.
4. He must inform the GDC within 7 days of any formal disciplinary proceedings taken against him, from the date of this determination.
5. He must inform the GDC within 7 days of any complaints made against him from the date these conditions take effect.
6. He must inform the GDC if he applies for dental employment outside the UK within 7 days of making any application.
7. He must not engage in single-handed practice.
8. He must confine his dental practice to posts within the National Health Service and not undertake any private practice.
9. He must not be responsible for the administration of any dental practice.
10. He must not undertake certain types of practice, namely dental emergencies, crown and bridge work, out of hours work.
11. a) He must, at all times whilst he is providing dental services, which require him to be registered with the GDC, place himself under the close supervision of a workplace supervisor. The workplace supervisor shall be a GDC registrant in the same category of the register as the registrant or higher. The workplace supervisor shall be nominated by him and agreed by the GDC by 14 February 2019.
b) He must provide the workplace supervisor with a copy of this determination immediately after the supervisor has been approved by the GDC. Evidence that this information has been provided to the workplace supervisor must be forwarded to the GDC within 7 days of disclosure.
c) The registrant’s day to day work must be supervised by a person who is registered with the GDC in their category of the register or above and who must be on site and available at all times. As a minimum, the registrant’s work must be reviewed at least twice a week by the supervisor via one to one meetings and case-based discussion. These bi-weekly meetings must be focused on all areas of concern identified by the conditions.
d) He must allow the GDC to exchange information with his workplace supervisor.
12. He must provide a report from his workplace supervisor to the GDC every three months and at least 14 days prior to any review. The report will address the following areas:
• Initial assessment and treatment planning
• Record keeping
• Radiography
• Consent
• BPE’s
• Fillings
13. a) He shall maintain audits of:
• Initial assessment and treatment planning
• Record keeping
• Radiography
• Consent
• BPE’s
• Fillings
b) The audits must be signed by his workplace supervisor.
c) He must provide copies of these audits to the GDC every 3 months and at least 14 days prior to any review hearing.
14. He must inform within 1 week the following parties that his registration is subject to the conditions, listed at (1) to (13), above:
a) Any organisation or person employing or contracting with him to undertake dental work.
b) Any locum agency or out-of-hours service he is registered with or applies to be registered with (at the time of application).
c) Any prospective employer (at the time of application).
d) The Commissioning Body in whose Dental Performers List he is included, or seeking inclusion (at the time of application).
15. He must permit the GDC to disclose the above conditions, (1) to (14), to any person requesting information about his registration status.
Registration History:
At a review hearing on 17 December 2024, the Interim Orders Committee continued Mr Jan's conditions, originally imposed on 30 January 2019 for a period of 15 months, for the remainder of the 12 months High Court Extension order. On 15 April 2020 the High Court extended the order for a period of 12 months. The High Court extended the order again on 28 April 2021 for a further 12 months. The order was extended for a third time on 29 March 2022 for 12 months. The order was extended by the High Court for a fourth time on 13 April 2023 for 12 months. On 18 April 2024 the High Court extended the order for a fifth time for a further 12 months. This will be reviewed in 6 months. The conditions on registration are listed on Mr Jan's register entry.
