The Case Examiners considered an allegation that the Registrant’s fitness to practise was impaired by reason of caution. The factual allegation related to the Registrant having been cautioned on 19 November 2022 for wilfully obstructing a constable in the execution of their duty on 18 November 2022, contrary to section 89(2) of the Police Act 1996. The Case Examiners determined that there is a real prospect of the factual allegation being found proved by a Practice Committee and a real prospect of the statutory ground of caution being established. The Case Examiners also determined that based on the available evidence and due to the Registrant’s level of insight and remorse with regard to the alleged conduct and low risk of repetition that there is no real prospect of a Practice Committee finding the Registrant’s fitness to practise to be currently impaired. However, the Case Examiners considered that the Registrant’s conduct may have been significantly below the standards expected of a dental professional. To therefore close the case without formal action would fail to take into account the need to declare and uphold proper standards of behaviour and conduct, and the need to maintain public confidence in the dental professions. The Case Examiners gave consideration to their Indicative Outcomes Guidance and considered it is necessary and proportionate to issue a warning to the Registrant regarding her future conduct. Furthermore, they considered that publication of the warning for a period of six months is appropriate and proportionate in the circumstances which will ensure that a message is sent to the Registrant and the wider profession regarding the importance of maintaining appropriate standards of behaviour. It will also address the level of public interest in this matter. The Registrant is reminded that this warning will form part of her fitness to practise history, even after it is no longer published and may need to be disclosed as required. The Case Examiners formally warn the Registrant that: • Wilfully obstructing a constable and the receipt of a caution for such is unacceptable conduct and should not be repeated. Any further conduct of a similar nature will be viewed seriously and is likely to call into question her fitness to practise. • She should comply with the GDC ‘Standards for the Dental Team’ and in particular Standard 9.1. ‘You must ensure that your conduct, both at work and in your personal life, justifies patients’ trust in you and the public’s trust in the dental profession.’
