The Case Examiners considered an allegation that the Registrant’s fitness to practise was impaired by reason of misconduct. The supporting factual allegations relate to the period between September 2018 to November 2018, and concern the Registrant providing dental services whilst failing to hold adequate indemnity insurance, which has been admitted by the Registrant. It was determined by the Case Examiners that there was a real prospect of some of the factual allegations being found proved, and that the statutory ground of misconduct had a real prospect of being established by a Practice Committee. They also decided that there was a low likelihood of repetition of the Registrant’s alleged actions, and that there was no real prospect of the Registrant’s current fitness to practise being found to be impaired by a Practice Committee. In addition, it was noted that the Registrant has obtained retrospective indemnity insurance to cover the period from 01 September 2018 to 25 November 2018 However, the Case Examiners considered that, although there is no real prospect of a finding of current impairment being made, there is evidence to suggest that the Registrant’s overall conduct had fallen below the standard expected to a degree warranting a formal response from the GDC. The Case Examiners have given regard to their Indicative Outcomes Guidance (February 2018) and determined that it would be appropriate and proportionate to issue to the Registrant a warning, published for a period of 12 months, having taken into account the GDC ‘Standards for the Dental Team’ (September 2013) provisions that govern him as a dental professional, and to indicate that this conduct should not be repeated. The Case Examiners also consider that a warning is appropriate and sufficient to address the level of public interest in this case. The Registrant is reminded that this warning will form part of his fitness to practise history, even after it is no longer published and may need to be disclosed as required. The Case Examiners formally warn the Registrant that failure to hold adequate indemnity insurance whilst providing dental services could hinder a suitably entitled patient seeking compensation if they have suffered harm. He must ensure that he has appropriate insurance or indemnity in place, to make sure patients can claim any compensation to which they may be entitled.
