The case examiners considered an allegation that the registrant’s fitness to practise is impaired by reason of misconduct. The supporting factual allegations included that the registrant provided antibiotics to a family member outside his scope of practice.
It was determined by the case examiners that the statutory ground of misconduct had a real prospect of being established by a practice committee.
The case examiners considered guidance in the Case Examiner Guidance Manual and Case Examiner Indicative Outcomes Guidance, and decided a warning was appropriate. This is so the registrant is fully aware of risks to public confidence in the profession, and to give him the opportunity to reflect further on how he conducts himself professionally. Publishing the warning will have the effect of highlighting to the wider profession that such conduct is unacceptable. This will in turn help protect the public and maintain public confidence in the profession.
Furthermore, the case examiners consider that publication of this warning for a period of 12 months is appropriate and proportionate in the circumstances and will ensure that this emphasises to the registrant, and to the dental profession, the importance of maintaining the standard of conduct required for GDC registrants.
The registrant is reminded that this warning will form part of his fitness to practise history, even after it is no longer published and may need to be disclosed as required.
The case examiners therefore formally warn the registrant that:
• his prescribing practise did not appear to follow the required professional guidance. The registrant must adhere to prescribing guidelines. Prescribing antibiotics inappropriately, particularly to a family member, is not in the best interests of the patient.
• any treatment, particularly prescribing medication, must be carried out within his scope of practice to prevent the compromise of patient care.
